Veterans History Project

For SCA Veterans and Family Members:

Congressman Jon Porter has asked me to assist him with helping to promote the National Veterans History Project within Sun City Anthem. I have also volunteered to assist the SCA Veterans Special Interest Group, the SCA Republican Special Interest Group, and independent SCA residents in this regard.

Accordingly, here are links to the national program and Congressman Porter’s initiative for the Nevada 3rd District.

Having worked with this national program since its beginning a few years ago, I may be able to assist a veteran or family member who may be thinking about participating in some way. Everyone who has served in the U.S. Military, past and present, can be remembered in meaningful ways.

This is a “history project” so those of you who lost family members in past conflicts can submit items to remember their past services. Individuals do not have to have been recognized in special ways. Millions of individuals have contributed to winning and preserving our freedoms.

Every service member is worthy of being remembered for their honorable contributions–regardless of their length of service or whether they excelled in combat or not. It was the millions of individuals who made up the whole team who have won and preserved our liberty. That includes individuals who served at any time in the 20th Century as well as since then.

Congressman Porter’s project is focused on making audio interviews by veterans or family members within his office. But, there are other ways to recognize individuals. I will be leading the effort to encourage other Nevada Members of Congress to establish parallel initiatives. It is also possible that a SCA project may be sponsored by the Veterans SIG. It is just a matter of finding some individuals who would like to help sponsor such work.

Ignore the Past?

Friends of SCA,We deserve better.

There are a few misinformed neighbors that believe in the theory if you ignore the facts the problems will disappear. It is no secret any more that Pulte/Del Webb may owe us a considerable amount of money. The reason is simple. It is because the board of directors on May 31, 2005 let us down. Pulte/Del Webb had a legal obligation on that date to fund the reserves of this association (and the neighborhoods) adequately. Ever since May 31, 2005 our board of directors have been looking the other way. They could have asked John Leach (our association attorney) to seek compensation, but they did nothing.  John Leach or RMI could have advised the board of directors to call upon Pulte/Del Webb to obey the Nevada statutes to fund our reserves, but they also did nothing.

Now there is a small group of people who want you to ignore the past, and join them in their dance around the May pole, and pretend that every thing is in the capable hands of the children on the board who are now spending your dollars to pay John Leach to defend them in the Ombudsman’s search for answers. The children on the board are also spending your dollars because they demoted Bob Frank, and they use John Leach (paid with our money), to do the butcher work.

They are constantly dividing our community with claims that our current BOD are not incompetent, or negligent, but are merely acting in our “best interest”.   Our best interest? – Bring me a shovel Harry!

They fail to address the failures of May 31, 2005. They now insist they can now solve every thing by doing yet another flawed reserve study. They now admit there may have been mistakes in the 2006 reserve study that was adopted by the board. Do they really think that Pulte/Del Webb will not take notice of those mistakes, and insist that they negotiate a lower dollar amount to compensate for those errors?

Take a closer look at the Villa Reserve Issue at Transition May 2005:

The task force is being run by the same guy who overlooked those “mistakes” in the 2006 reserve study. If he wasn’t competent enough to find those mistakes in 2005 (when he spent two months examining that reserve study), why is he now the chairman of the task force to do a new reserve study?

Since when has it been “acceptable” for a committee (or task force), chairman to refuse to answer questions from the people who are affected by his decisions?  What country do we live in?

Our current BOD has been deceiving 162 Villa homeowners. These are indisputable FACTS:

  • All 162 Villa homes were to be painted in 2008.
  • By raising the dues $500 for every Villa home owner in 2007, $81,000 was contributed from the Villa home owners.
  • An “agreement” added $241,718 (plus some improvements) fromPulte/Del Webb
  • EVEN WITH THE $81,000 ADDED TO THE DEVELOPERS $241,718 THERE WAS NOT ENOUGH MONEY TO PAINT ALL THE VILLAS IN 2008 AS IT WAS CALLED FOR IN THE RESERVE STUDY.

Why was there not enough money?  Because Pulte/Del Webb came up “light”.

RC3 -  COGEN: The current board has to deal with another agreement/ Document of Understanding (DOU) they have inherited from the Del Webb Corporation made with what Del Webb referred to as “resident leaders”.  This May 1, 2002 DOU is signed by Chris Haines Del Webb Corporation General Manager. Co-Generation Plant Del Webb will fund up to $1,375,000 for the development and construction of a co-generation plant. If unfeasible, the entire amount will be donated to the reserve fund at transition.  Period! End of Story!

How many dollars have we lost?  How can you put a value on the bad blood between volunteers, neighbors and fellow homeowners that exists today?  When is enough, enough? When will we get a board that cares about the residents and not the “roof tops”?

One thing that I do agree with, “carefully study and listen to the candidates we have this year and choose wisely.”

Check Military Retiree Beneficiaries

Military Retirees: The following item is provided for your information.

Nelson Orth has reported that a personal friend recently received his Military Retiree Account Statement and the beneficiary listed on the back of the form had been changed to a name he did not recognize.

Nelson’s friend has not yet learned how such a serious error could occur, but it is clear that all military retirees and their survivors should review the back of their Military Retiree Account Statements and verify whom they have designated as the beneficiary in the event of their death.

Military survivors may find it extremely difficult and expensive to correct such an error if they do not catch it beforehand.

We Deserve Better

There is a very important election for 3 new Directors this April.  We have the opportunity to install change that will benefit every homeowner in Sun City Anthem.  Please take advantage of this opportunity. 

Whether you have lived here for 10 years, just recently joined our wonderful community or somewhere in-between we have all been flimflammed, bamboozled and otherwise lead down the garden path concerning our finances.  Millions of dollars are missing and each of us will be forced to pay that bill unless we take action. 

Some examples: 

The developer promised, in writing, to deposit well over $1 Million in compensation funds into our account no later than June 1, 2005.  We do not have that money yet. 

Nevada law required the developer to pay their share of our reserve funds no later than July 1, 2005.  There could be over $2 Million missing.  We do not have that money yet. 

By contract our community manager is required to collect all rents from the lessee of Trumpets restaurant.  They failed to collect over $1 Million.  We do not have that money yet. 

Responsibility for pursuing our debtors and collecting our money falls directly upon our board of directors.  They have let us down.  Whether due to incompetence, negligence, deliberate deceit, runaway ego, or other reasons the fact is we do not yet have our money after more than 2½ years.  We do know that at least some, and likely many, directors we have elected and entrusted to care for our finances have engaged in secret, illegal, meetings as well as otherwise obfuscated and hidden the truth from us.  Their motivation for this behavior is not clear but the pattern suggests placement of the desires of the developer ahead of the rights of homeowners. 

The result is not only do we not have the money due us, it is even worse.  We have been forced to sacrifice $400,000 in 2006 and $900,000 in 2007 in excess dues we paid that otherwise should have been returned to us by law, that is about $200 per household.  Plus this year we are being forced to pay an additional $100 to make up for the missing money our directors have failed to collect.  That amounts to about $300 per household and about 7,000 households for a total of over $2 Million.  That is how we have been required to personally pay the bill so far. 

That is not fair.  We deserve better.  The only way we are going to recover the money entitled to us is to change the direction of the board with new members who are not only capable but also have the will to right the wrongs. 

Carefully study and listen to the candidates we have this year and choose wisely.  We have the opportunity to install change that will benefit every homeowner in Sun City Anthem.  Please take advantage of this opportunity.

GOP SIG to Discuss Health-Care Solutions

The Sun City Anthem Republican Special Interest Group announces what should be an interesting meeting on Sunday, January 27, from 7:00 to 9:00 p.m. in the Morris and Nelson Rooms at Independence Center.

Mr. Len Lunar will be the guest speaker, presenting an overview of Health-Care Solutions proposed by the Heritage Foundation.

In addition, Bill and Mary Ellen Cushard will present materials and information on what to expect at the Clark County Republican Convention. All delegates and alternates to the convention should find this evening very interesting.

Getting it Straight

There has been some misinformation about candidates for SCA Board of Directors running as a slate.

I have met and talked with all of the candidates running for our Board of Directors. All of us have one thing in common and that is a real desire to improve the quality of life for all the residents of Sun City Anthem.

If improving the quality of life was the only issue in this campaign, we could all be running as a slate. However, that is not the case.

Although three of the candidates have opted to run as a slate, the remaining four have chosen to run as individuals with some common but different ideas and ideals. We also place different emphasis on different problems that confront all of us. I am one of those four who have chosen to run a separate campaign, emphasizing my own strengths, hopes and plans which will most benefit all of our residents.

Although I recognize that our financial history and present financial condition are of considerable importance, the past negligence and/or financial discrepancies will not be my major focus, important as that subject is. Other candidates in this campaign will be focusing on that area of community concern and I support those efforts.

Because of my background in administration and community service, my emphasis will be on improving the conditions and lifestyle in our community and improving the administrative functions of our board.

I am looking forward to serving on our board and I will bring some new ideas and fresh energy to the Board. I hope that you will watch the candidate videos that will soon be running on Channel 99 and you can see for yourself how different or silmilar all of the candidates are.

Board Meeting Highlights

I would like to compliment the board for a great move at yesterday’s board meeting: Many times I have heard residents complain, myself included, that something must be done to inspire delinquent homeowners to pay up or face some kind of consequence. At the BOD meeting 1/24 a unanimous vote passed the inactivation of activity cards and a new rule that would bar members who are 90 days delinquent in their dues. BRAVO!

No decision on the Trailhead easement grant yet, Many members were at the BOD meeting giving their pros and con view points and the board was reminded once again that petitions are circulating that, as of now have in excess of 400 signatures calling for no improvements. The Park and Recreation department met with Mike Dixon, Diana Shen and two un-named residents of Shadow Canyon who Mike names to represent all 1,000 plus who lived in that village. In his statement he said he will hear the people. It’s your community, let the board know what you want.


Trailhead Issue Status

The January 24th Board Meeting Agenda calls for a board vote to approve two easements to allow Henderson to construct a public park rest area in Shadow Canyon near the Recreation Center 3 site and to provide another public access through a Shadow Canyon street to the Anthem East Trail.

A small group of residents are promoting these park development areas within SCA, but hundreds of affected SCA residents have signed petitions demanding the easements and park construction plans be rejected.

The attached paper outlines the basic issue. Cost to Assoc. ???

Several residents of our community have been challenged regarding the costs they have caused the association by complaints sent to the Ombudsman’s office. We would like to set the record straight on that. When any resident makes a complaint to their Board of Directors and it is not handled in a satisfactory manner, they have the right to take it a step further and request help from the Ombudsman’s office. We all pay to support the Ombudsman’s office for that right. There is NO FEE involved, NO ATTORNEY NEEDED.

The Ombudsman is an arbitrator of sorts, the idea is, that the person filing the complaint, the Ombudsman and a member of the Board will meet, l sit at the meeting table and hash out the problem to reach an amicable understanding agreeable to all.

Expenses to our association have come into the picture because our Board of Directors chose to have the association attorney speak for them. This forced the complaining party into a corner where they must either give up, or hire their own attorney.  Since No attorney was needed, a fact that can be verified by calling the Ombudsman’s office, it is a gross misuse of association funds.

Commitments are to be honored

At the board meeting last August Mike Dixon urged the directors to attempt a removal of Bob Frank as Vice President of our Association. This angered a large portion of our community. Board candidate John Briggs and I filed a complaint with the Nevada State Ombudsman citing this action violated Nevada laws established to protect the rights of Mr. Frank as well as the rights of Sun City Anthem homeowners and therefore was illegal and invalid.

Earlier this month a formal hearing was held by the Ombudsman to resolve the complaint. At that meeting Mike Dixon agreed to place an item on the agenda of the January 2008 board meeting to remove Mr. Frank as Vice President in a manner fully accommodating Nevada laws. All parties agreed this was a satisfactory solution to the complaint, and the Ombudsman expressed her thanks stating the matter was resolved and the case file was closed.

During the Town Hall Meeting of January 17 John Briggs asked why the draft agenda handout provided to homeowners did not reflect the agreed upon action item? Mr. Dixon replied the agenda item would be added next week at the board book meeting.

After the meeting ended Mr. Briggs and I went to Mr. Dixon and thanked him for his assurance the agreed agenda item would be added.

Mr. Dixon then said he actually chose to refuse to honor the terms of the settlement committed at the meeting with the Ombudsman and would not place any legally framed removal topic on the agenda–as he originally guaranteed. Mr. Briggs and I were shocked and stated that was not fair nor in accord with the promise made at the meeting by Mr. Dixon. Mr. Briggs suggested that if this were now to be the case, Mr. Dixon might not have told the truth to the Ombudsman and to us as part of the agreement to resolve the serious matter and never intended to perform as promised.

Mr. Dixon flew into a rage. He advanced toward Mr. Briggs, leaned into the face of Mr. Briggs yelling loudly, jabbing his finger at Mr. Briggs and spraying spittle into the face of Mr. Briggs. This seemed to be a deliberate (unsuccessful) attempt to provoke Mr. Briggs into some sort of verbal or physical reaction.

Mr. Briggs, staying cool, kept his composure and professional self-control. He backed away but Mr. Dixon advanced toward him again, and again, yelling, poking and spraying. At about the time it seemed necessary to intervene to protect Mr. Briggs from Mr. Dixon, Mr. Dixon stomped away still poking his finger in the air and screaming to shocked residents how much he disliked Mr. Briggs. The still very composed Mr. Briggs simply shook his head in disbelief that any adult, let alone the President of our Association, could behave in such a manner as he watched Mr. Dixon stomp toward the exit.

The Ombudsman was promptly notified of Mr. Dixon’s refusal to honor his commitments, and she immediately referred the matter to the Nevada Real Estate Division’s Compliance Branch for investigation. A formal investigation of statute violation could lead to the removal of Mr. Dixon from office.

It is worthy to note that at official meetings with the Ombudsman no one is sworn to tell the truth. Such meetings seem to be structured so that honesty is a matter of personal integrity, honor and trust.

What is it About That DUCK?

Monday, January 14, Big Sky Women’s Club held their annual “White Elephant Lunch” over in Independence hall  and everyone had to agree that the star of the day was a yet to be named DUCK. The object was for each of the members to bring a wrapped gift that, once opened, could be “stolen” by another member if they would rather have that than pick an unwrapped gift from the table when their turn came. The gift table was plentiful of wonderful items consisting of an array of items running the gambit from colorful platters, to baskets from Bath & Body, greeting card assortments, coffee mug sets, etc…… AND the DUCK.. he/she was an antique looking statue that one could placed in the home, and it became a favorite that was “stolen” over and over again to the glee of all. Until one member finally asked if it could be auctioned off to pay her daughter’s vets bill.

To say this laugh filled luncheon was enjoyed by all present would indeed be an UNDERSTATEMNT.

To Speak or NOT?

 A statement was made at the Town Hall Forum today chastising a group of SCA residents for going to the City Council meeting to voice their concerns about the Shadow Canyon trail head improvement and to ask the City some questions directly.  This action was initiated since straight answers don’t seem to be forthcoming from any other source. It is ANYONES right, as tax paying residents of Henderson, to ask questions of our elected officials.  

When we buy into a HOA community, we agree to follow the rules of that community, we DON’T AGREE to give up our rights as citizens of the city, state, or country in which we live. Those rights, as I remember them, are the rights of free speech in a free society called the United States of America. Am I waving the flag, you bet! 

At the Forum today, Chuck Davis stated that only the President of the BOD, and before that, the Oversight committee,  had the authority to address  the City Council.  I take great umbrage with that statement, or part of it. Were a resident to say that they REPRESENT SCA,  I would agree, however, no one from Sun City did that. Each of the four residents that spoke,  myself included, spoke as individuals. Not one person even HINTED that they represented the COMMUNITY. I don’t believe that Mr. Davis, the Board of Directors or anyone else has the right to state that we homeowners should be denied access to ANY OF OUR ELECTED GOVERNMENT OFFICIALS, ANYTIME, ANYWHERE.

While we are on the subject, our elected official, Councilman Hafen, offered to have someone from Parks and Recreation  attend  the January BOD’s  meeting next Thursday to answer resident’s questions regarding the Shadow Canyon Trail head improvements. Mike Dixon was also there in the back of the City Council chambers and today, at the forum,  he promised to have Caren send out an e-mail notifying the community that this will be done. Finance Committee Report

The Finance Committee Fails Us Again

The 12 January Finance Committee meeting was chaired by Mr. De Meo since the regular chairman Don Manning was on vacation. The primary purpose was to listen to three presentations from accounting firms that desired to be hired as our auditors, and then for the Finance Committee to recommend one to our board. One presenter was obviously unprepared, and was never seriously considered

Another presenter was from our current auditing firm, Kilburn and Lein. They gave an adequate presentation focusing on the fact that they had been our auditors for the past seven or eight years, knew the people here at SCA and RMI, and were familiar with the way business was conducted..

The third presenter was from  Kane and Company, and without question, their presenter was the most dynamic, forward-thinking, and comprehensive of the three. He showed a booklet about HOA operations that he authored and continues to update, and provided all committee members plus several board members in attendance guidance booklet about maintaining reserve accounts. Without a doubt, Kane and Company was head and shoulders above the competition.

There were five or six residents in attendance, and to the best of my recollection four spoke in favor of Kane and Company. One resident in particular, a well respected retired CPA, articulated the many benefits that would be derived from hiring such a company. The big mistake that Kane and Company made was knowingly coming in high on their fees. However, the cost differential was far less than we are going to pay for our interior design decorator. 

When the final vote was tallied, resident opinion was once again rejected. The recommendation will go to the board to retain the services of our current auditor. There was one vote to reject, and that was Rich Pendleton. I applaud him for his foresight and wisdom to keep the best interests of the community at heart.

However, there is still hope. Roz Berman, board treasurer and representative to the Finance Committee was fairly silent on these entire proceedings so I do not have a good impression on exactly where she stands. I encourage all residents to become more informed about these two companies who want to be our auditors and let your board know your thoughts. We have made a great issue in the past year about who our legal counsel should be. In many ways the decision on who our auditor is just as important.

Update on Trailhead Issue

For SCA resident information, I sent the attached email this morning to Ms. Mary Ellen Donner, Henderson Director of Parks & Recreation. Perhaps it can provide some of the missing information on why so many of our SCA residents in the new villages (particularly in Shadow Canyon Village) have been surprised by the current proposal to grant easements for constructing public trailhead enhancement facilities within the SCA community area.

It is my understanding from Ms. Donner that the request for the trailhead enhancements came from individuals within SCA; and, that if SCA residents prefer to not have the public facilities installed and maintained by the City, that is fine with Henderson. Henderson understands this is a senior community and the majority of those affected may prefer to avoid the expanded public use of the trail through its areas. If the easements are not approved, the City has many options in other areas where the funds can be used to construct facilities. It is strictly up to SCA to decide what is best for our members.

An Apology is Due

I have a friend named Tom Hamilton who lives in a Villa, The Club House Neighborhood. One day Tom got a phone call from Jack Troia. Jack is the Chairman of The Reserve Fund Task Force that is now engaged to look back in time and find out how much is owed this association, and the neighborhoods (by Del Webb), as of May 31, 2005.

Jack asked Tom if he would volunteer to serve on the task force, and Tom agreed. He was to serve on the committee as a representative of The Club House Neighborhood. What Jack did not inform Tom was that asking questions would be “off limits”. Jack also did not tell Tom that making inquiries about why his particular neighborhood was only funded at 10.7% as reported in the 2007 budget was a question he would not permit.Jack also did not inform Tom that he would not be allowed to ask why Del Webb only reported $4,800 in the bank on May 31, 2005 (for 32 units), and the homes were then more than six years old.

Jack never told Tom he would not be allowed to ask why there was not enough money in the reserves, or why the developer did not pay into the reserves from 1998 to May 31, 2005 (except for the $4,800).Tom showed up, ready to do the bidding of Jack Troia, but after Tom asked a few questions, he was summarily dismissed by Jack Troia, and sent home.

In my humble opinion, Jack Troia owes Tom Hamilton an apology, and an explanation why he refuses to answer questions that concern all the Villa owners as well as the reserves of his neighborhood.

Jack Troia has served at various positions on the Finance committee, since Feb. 1, 2005 (before the transition date of May 31, 2005.) He knew that the developer had not complied with The Nevada laws that require a developer to conduct a reserve study at the time of transition, and properly fund it.

Jack (and the finance committee) never suggested that the board of directors ask the developer to comply.I think Jack owes all of us an explanation, AND an apology.  

PLEASE Lock Your Car!

Today, the following two incidents were reported:  
Both Incidents were in Anthem Center Parking Lot and happened when women parked their cars and went into the gym…. Please be more vigilant PLEASE LOCK YOUR CAR. It is sad to know that we are no longer that safe, even this close to home.

The resident reported seeing a “strange older man” standing around the cars when she went into the Anthem Center Gym at about 8 PM on January 14, 2008. When she returned to her car, she noticed her interior lights were turned off, and her gym bag, dance shoes and several other items were missing while she was in the gym.

A second resident reported her truck was broken into at about 9:30 PM on January 14, 2008 while she at work.  She works at the Anthem Center Gym.  She was not sure what was taken.  This resident reported her driver’s seat was placed in the fully reclined position.

Tree Cutter must pay the penalty

Douglas Hoffman, AKA The Sun City Anthem Tree Killer, ordered to serve 1-1/2 to 5 years in prison and pay almost $250,000 in restitution.  Even his attorney admits he is guilty.  A fitting end to a very bad situation.
