Weinstein Accused of More Violations

For those who attended the last two board meetings, you are aware that Carl Weinstein is in a personal tailspin. Although he claims to be a 35-year experienced HR manager with a MBA, he seems unable to act professionally throughout an entire Board meeting. And, once again, Roz Berman was unable to manage Carl’s misbehavior.
During the July Board meeting, Carl Weinstein was even more offensive than in June, and he flagrantly violated four (4) laws–which is more than in the June meeting. Unfortunately, Director Bob Frank has no choice but to file yet another official violation letter against such outrageous behavior, and to call official attention to his many violations of Nevada Statutes and the SCA Code of Conduct. This Weinstein situation is turning into a serious problem for the community.
If you find this whole situation confusing, you are not alone. None of the Board’s behavior of constantly attacking/attempting to bully Bob Frank and other honorable leaders in our community makes any sense to a normal person. But, remember this kind of sustained board misconduct has been going on for years. This is not a trivial political struggle among just one or two individuals. Many individuals are involved at all levels, and the long-term stakes for this community with an $8 Million annual budget are high.
The current wasteful legal maneuvering is costing SCA many tens of thousand of dollars–while it casts a dark cloud over our community’s lifestyle and pumps up John Leach’s invoices (while he is rapidly growing his new law firm).
The only way to stop this outrageous behavior is for the community to require the board to stop bullying innocent leaders, and for the board to finally be forced to agree to an independent forensic audit to settle the financial disputes.
Ask yourself, why would anyone be fearful of an forensic audit–if there is nothing to hide? No matter what it would cost, such an audit would be far cheaper in the long-run than all of this wasteful legal activity. With an independent, forensic audit we could finally learn the truth, and be able to accurately plan for SCA’s future.
But, this means that every SCA homeowner has a responsibility to help. This situation is sort of like it was after the Boston Tea Party when the citizens refused to cooperate with paying more taxation, or when the old West Dodge City residents decided that enough-was-enough and that law and order in their town was not optional.
SCA homeowners will eventually find it impossible to sit this out. But, how bad does it have to get before many homeowners get mad enough to do something? If you are already in the mood to do something, send us email at:

Board Owes for Frank’s Legal Defense (Updated)

In spite of the loud disclaimers heard at last month’s board meeting, Director Bob Frank has confirmed that the Board’s massive personal attack against him through the Nevada Real Estate Division since last August has cost the association $28, 782.20 to defend him against the board’s unsubstanciated allegations.
That makes the total attorney defense costs to date to be at least $28,782.20 plus $15,000 for the insurance deductible fee for a current total of $43,782.20.
This current total does not include any of John Leach’s time. Here is the letter explaining the details:

Weinstein Fails on “Unity Promises” of Respect

If you were paying attention to the “Unity Party Promises” you heard Carl Weinstein repeatedly say “If elected, I will be respectful!” Listen to this frequently heard sound byte promise:

But, how has he really performed after getting elected? Because of his past temper tantrums, we suspected he could not deliver. Sure enough, here is a sound byte from his explosion during the June Board Meeting:

Would you call that an exceptionally poor performance from a so-called, 35-year-HR manager? Could there be anything that a member says during a member comment period to justify such a vicious insult from a board member? And, what was our Board President, Roz Berman, doing while this violation was happening? Why, she was actually participating in the harassment! Does it sound like harassment to you?
Is it any wonder Weinstein and Berman have been accused of code of conduct violations and that some members are wondering if those two should continue to serve as board officers?

There is one “village” within Sun City Anthem that is gated and is called the Pinnacles. The other 23 villages are not gated:

Foreclosures are a problem in the villages that were under construction when the buying hysteria was in full swing three years ago, with most foreclosures resulting from “investor’s” properties not capable of being ‘flipped’ as they have envisioned.”

“…I can not comment about what it is like to “live” in the other senior communities–I can only comment about what one learns from visiting the other areas and from talking to those who have relocated. We should encourage residents of those other communities to comment on what they like, and if they had it do again, where would they go? Sun City Anthem has hundreds of residents–homeowners and renters–who have moved from the other Las Vegas senior communities, and that speaks volumes to me. Finally, it makes a big difference to non-golfers if the community does NOT own the golf course. The long-term costs and potential liabilities of maintaining golf courses in the Las Vegas area are significant drains on dues. If one is a golfer, and not wealthy, the least long-term costs of golfing seems to be to live where the courses are not owned, but one can easily drive to the best value courses available. For us military retirees, we can always play at Nellis AFB [about 50 minutes away, door-to-door] which most people believe will never be closed, and always be maintained at a high quality.)
My observation is that some of the other comments may have been written by real estate people or investors–not individuals who know from first hand about the differences in lifestyle and pleasures of living in the various senior communities. That is ok, but feedback from residents is also important.
IMHO, Sun City Anthem is the true crown jewel of the Del Webb senior community developments. It is only 9 years old with 7,000 homes and the last new homes are being built this year. We have an average age of 61, and our residents are truly “active”–many are not yet fully retired. This is the perfect “boomer” retirement community. We have the best balance of amenities of any place I have ever seen–it is like a cruise ship on land with 3 major recreation centers (last one being built this year).
The dues are below average for this area, and I expect them to stay low since we do not own and operate our ajacent golf courses. Some prices have decreased because of the normal market situation and due to some heavy speculative investors in the 2004-2005 period. Pulte got really greedy and allowed some individuals to buy blocks of up to a dozen homes at a time. That caused some unrealistic short-term price increases that are now being corrected. I know of no “real seniors” who are being foreclosed on. Only the speculators/property flippers are paying the piper.
However, those investor losses are providing some really good, short-term buys for REAL retirees. Many of the properties are still new–not previously occupied. Next year at this time those bargains will probably be gone. I have been here a few years, and I recently helped a fellow veteran join me and hundreds of other veterans in Sun City Anthem. They moved from Albuquerque and they are extremely happy with the value of their home and our unique community environment.
Sun City Anthem is not like other LV retirement communities. We are way up over two thousand feet on the North side of Black Mountain–way above the din of the Las Vegas tourist traffic and only 20 minutes South of the airport. Even those who do not have a private view of the entire Las Vegas Valley need only to walk a short way to have a wonderful (day and night) view of the Strip and the surrounding mountains. The air quality is truly wonderful, the noise level is near zero (particularly after 8 PM each evening), and the community/home designs allows almost every home to have great privacy.
If one likes the dry desert air, being next to the new city of Henderson, NV (now the second largest city in NV with no depressed areas) and only a few minutes from the vast entertainment options of all of Las Vegas, I believe there is no better place to retire than Sun City Anthem.
So, my message is focus on the value of the lifestyle and environment. Many retirees can live in many places, and they can buy a good home, but spending perhaps a few dollars more for Sun City Anthem, Henderson, NV will pay back many times over with the quality of life, the quality of location, and the quality of the people in the community. And for the record, I am NOT in any way associated with real estate or development or benefit in any way from my comments. I just happen to love living in this wonderful place, and I like inviting other good people to share the joy. ”

“Wow! Those last two posts have me, if already not, sold on Sun City Anthem. It’s wonderful to hear from actual word of mouth how much someone totally enjoys their life and lifestyle there. I’m certain I would too. In fact, I have already chosen, from the many models offered, three floorplans I would really like. I or we, don’t know which it will be yet, will be arriving next weekend to thoroughly learn the area. I am in total agreement with everything Serviceman has said other than no trashed areas of Henderson. Sorry, I have lived in this valley most of my life and I guess he has not come down of of our beautiful SCA hill enough and drifted in the “wrong” direction. but that’s O.K. Right–I am probably guilty as charged. I think I have been over most of Henderson, and have not seen any areas that I would consider truly “depressed” but I can not claim to have been everywhere.
I am so happy with living in Sun City Anthem that I probably see most things through rose-colored glasses. Whatever the case, any problem areas in Henderson are probably so contained that perhaps the topic is not worth a lot of debate? “

Trumpets Failure Excuses Coming From Dixon?

According to Ron Johnson, who has recently talked to the Boulevard Gaming Group management, Mike Dixon has totally failed to reach agreement on a lease, and he is getting ready to try to blame everyone but himself. He is already starting to try to blame the women’s club, the negative bloggers, and of course, the Franks.
We are used to this kind of denial behavior from Dixon (who acts like one of those narcissistic “legend in his own mind” kind of man); but, since he had 100% control of this Trumpets lease process from the beginning, it will be hard for even him to to deny his total and complete failure.
So, as he and Roz Berman (and her spouse’s notoriously negative blog) begin to spin the excuses and try to cast blame on everyone else, just ask yourself, have your ever heard either one of them ever admit to making any mistakes of any consequence? If so, send us your examples of such, and we will give them due credit.
In the meantime, get ready for the blame game. It promises to get really nasty this time.
Even Dixon’s and Berman’s friendly associates will be extremely dissatisfied with the time and money wasted during the past year while Dixon, Sansing, and the Bermans were fooling around with that shockingly inadequate and totally compromised LuvRules mess–as orchestrated by SCA resident Patty Shock.
We remember that Ms. Shock was Dixon’s highly-touted, UNLV restaurant management “expert” recruited to guarantee success. But, when she had to resign after being exposed as having serous conflicts of personal interest (her preferred bidder was living with her in her SCA home), she also blamed everyone but herself. Do you see a pattern here?

Invalid “Interview”?

Many SCA members have been discussing Board President Roz Berman’s “interviews” with her infamous spouse, David Berman, as published on his notorious, “David’s Anthem Journal“. It is found at this link:
Her spouse’s latest, so-called “interview” was supposed to be a factual discussion about her behavior during the June 26th Board Meeting. We invite you to compare Roz Berman’s words on the Berman Blog with the recording of the actual meeting. What a stark difference!
But, we now know that during that meeting her insulting and abusive behavior resulted in a formal SCA Code of Conduct and Nevada Statues complaint by Kay and Bob Frank. (See this link for details.)
But, what about the accuracy of the so-called interview? The Bermans paint quite a different image on their web site of the meeting than the recordings and transcripts reveal.
To get to the truth, Bob Frank recently asked Roz Berman by email if the: “…article (posted by you and your spouse on your family web site) was an “official” statement that our community members can quote and respond to?”
Roz Berman replied: “No, the article is not ‘official,’ and the blog is not a ‘family web site.’”
Bob Frank also asked: “Or, will you be posting something different on the SCA-HOA web site?”
Roz Berman replied: “No.”
So, it appears that Roz’s suspended attorney spouse has published yet another of his tall tales and falsely proclaimed it to be a legitimate “interview.”
But, in this case, Anthem VOICE readers can personally access to the truth by reviewing the online transcript and by listening to the online sound bytes from that Board Meeting. Readers can also review the transcript of Roger Grant’s seminar that Roz (mistakenly) used to try to justify her misbehavior.
It is no wonder that she can no longer stand behind her spin-doctor spouses’ “interview”! The “Berman Interview” is exposed to be the sham that it is. And, if you are one of those members who appreciates knowing the truth, you are fortunate indeed that AV is around to expose such deceptions.
Will you join us in insisting on truth and honesty and requiring that there being a public hearing and appropriate sanctions concerning the facts in this case? We need to demand that there not be yet another cover up about board president misbehavior. Tell the board and your neighbors to seek open and honest justice on this matter.

Weinstein Deceives With Fauxpology?

Someone has asked me why did I “accept” Carl Weinstein’s “apology” for his verbal abuse of me during the June 26th Board Meeting, and then file a Code of Conduct Violation against him on July 3rd? If you have not yet reviewed the case, the details are in this file: coc_3jul08_public.pdf
For my answer, I ask members to review the attached article titled: “When An Apology Is Not An Apology“. Fauxpology.pdf
Here is an extract of the article for your convenience: “…the criteria a statement has to fulfill in order to qualify as an apology, and in layman’s terms, we can say that it requires two parts: 1) regret (the “I’m sorry” or “I apologize” part), and 2) responsibility (some explicit statement that you were the one who did the thing that’s being apologized for). The statement “I’m sorry that I borrowed your jacket without asking,” for example, meets both of those criteria. There are several other conditions which will disqualify a statement as an apology if they’re not also met (for example, if you don’t actually regret the thing you’re apologizing for, and are only saying you do in order to curry favor with the apology’s recipient), …” “…basic form is pretty darn basic: regret, and responsibility. They’ve both gotta be there, or else it’s not an apology. Often, people will use a rhetorical trick in which they make a statement that has a lot of the superficial trappings of an apology, but without one or both of those basic criteria of form. I call these statements “fauxpologies.” One classic type of fauxpology is to say something like: “I’m sorry that you’re upset about me borrowing your jacket without asking.” This fulfills the regret criterion, but not the responsibility criterion, since the speaker is expressing regret not for an action, but for someone else’s emotion.”
In other words, Carl’s statement was not a sincere apology, it was a “fauxpology“. After reviewing the words and tone of his statement from the recording, you can clearly hear that he did not intend to sincerely express regret for his repeated attacks on me, nor did he intend to accept any responsibility for his gross failure to respectfully behave as a board officer.
Most importantly, Carl did NOT retract calling me a liar during the Board Meeting (which he had done repeatedly.) In my opinion, after thinking about it for a couple of hours, he realized he had made a public spectacle out of himself, and he hoped others might miss the deception in his trained, HR-manager-styled fauxpology.
Normally I am a generous person who tries to be quick to forgive honest mistakes. But, Carl Weinstein has insulted me in the past, and I recognized his technique of only offering “fauxpologies“. He has a history of publicly insulting me and privately fauxpologizing using the classic, ” if I offended you…” In this case, his and Roz Berman’s repeated, calculated, and outrageous behavior used against me on June 26th were so obvious, so intentioned, and so serious that they could not be ignored.

Berman/Weinstein Accused of Violations

On July 3, 2008, SCA Board President Roz Berman and VP Carl Weinstein were publicly accused of multiple counts of flagrantly violating multiple statutes and a mix of SCA governing rules as a result of their gross misbehavior at the June 2008 Board Meeting.
This promises to be a unique case. Where most Code of Conduct allegations are handled in confidence, this one is completely different. Everything is out in the open and subject to community-wide discussions and judgments.
