HOA Advocate Gazette Features SCA Stories

Diane Gerber’s “HOA Advocate Gazette” has picked up on and featured the Henderson “false arrest” story about Tim Stebbins and Bob Frank.

It also highlights Johnathan Freiderick’s report on the “3 amigas”

who showed up to reveal to the Senate Judiciary Committee and to the thousands watching via Internet streaming media as the hateful and self-centered people they are.

Their shockingly anti-homeowner and incompassionate attitudes were exposed in this highly public environment and has been recorded via the Internet.  Such egotistic behavior is usually reserved for the home crowd attending board meetings, and when socializing among the community members who enjoy kowtowing to them.

Confidentality of Board Complaints?

Contrary to the blatantly false information on D. Berman’s blog stating his opinion on the supposed confidentiality of complaints against the board, I know the following to be true:

1. NRS 116.757.1 says: “1. Except as otherwise provided in this section and NRS 239.0115, a written affidavit filed with the Division pursuant to NRS 116.760, all documents and other information filed with the written affidavit and all documents and other information compiled as a result of an investigation conducted to determine whether to file a formal complaint with the Commission are confidential.”

2. This statute section was proven to only prohibit the Real Estate Division from releasing any information provided to it during mediation and investigation phases to third parties. The NV Legislature never intended for the Real Estate Division to block any US or NV Constitutional due process rights of the parties. Any competent attorney would know that to be true; but, there have been times in the past few years where a “cone of silence” was wrongly placed over all parties of some cases. Those actions by the Division clearly violated the respondent’s fundamental constitutional rights.

3. The accusing party is required by law to (a) sign its complaint under oath, (b) release everything in its allegations to the respondent/accused, and allow a reasonable time for the accused to respond BEFORE an affidavit is filed with the State. Nothing in the complaint filed with the Division can be held from the respondent. In addition, the statute prohibits the Division from accepting an Intervention Affidavit that has not been fully disclosed to the respondent and time allowed for a response.

4. Both the accusing party and the respondent can release anything they wish to anyone, at anytime.

In conclusion, since David Berman appears to be speaking for both himself and his Board President spouse, our community should demand that Roz Berman seek assistance from her fellow directors–especially current member of the NV Bar/former judge, Ann Small.

What does it say about the directors if they remain silent while such flagrant deceptions are being distributed by a former board VP?

110+ Attend AV Seminar on April 7

An ANTHEM VOICE seminar attended by over 110 SCA homeowners was held in the Anthem Center on April 7 from 6:30—8:30 PM. It was arranged and hosted by Bob Frank, Ron Morse, Ken Anderson and Tim Stebbins.

This event covered a wide variety of issues of current concern to Sun City Anthem homeowners. The meeting room was rented by AV and made available free of charge to all SCA residents. AV seminars are offered so Sun City Anthem residents can have access to the latest information available on issues affecting their health, lifestyle, and home maintenance. Anthem Voice seminars draw upon the exceptional skills of SCA residents in combination with outside professionals. Invited professionals attend at no cost and no obligation. They are present to assist our SCA members with unique information. Useful handouts on most issues are made available to attendees.

After an introduction by Bob Frank, the 1st session focused on the Bureau of Land Management (BLM) open pit mining project planned for 3 miles south of the community. Bob had made the Anthem VOICE arrangements with BLM to make the presentation. George Meese, SCA’s volunteer Committee Chair to Oppose the Mine, served as session moderator.

After some introductory remarks, Mark Chatterton, Assistant Field Manager for Nonrenewable Resources for the Las Vegas BLM Field Office, answered resident questions and instructed them how to best make their voices heard on the issue. He emphasized the need for sending individual letters to BLM and senior government officials that focused on health, air quality, traffic, and the expected extremely high water consumption concerns versus personal financial impacts. It was generally agreed that the session was exceptionally useful, and that many more such events were urgently needed.

Session 2 was moderated by SCA homeowner Ken Anderson. Mark Cook assisted. This session focused on SCA homeowner construction defects. Expert presentations included information on yellow brass plumbing failures in Kitec, Rehau and Wirsbo systems, floor tile cracking, slab cracks in Del Webb Phase 1 homes, patio/flat roof drainage problems in DW Phase 1 homes, and Pulte sewer backup valve problems.

Speakers included construction defects special attorney Troy Isaacson from Robert Maddox & Associates who provided up-dates on SCA home construction defects issues.  Mr. Isaacson also included details on why homeowners should immediately get involved with strongly opposing Senate Bills 349 and 337. These bills are intended to radically modify construction defects laws to the great advantage of developers and builders.  For example:

·    SB 349 would allow builders to violate building codes without penalty and take away homeowner rights to legal fees when they are sold a defective home.

·    SB 337 cuts in half the amount of time a homeowner has to hold a builder accountable for construction defects and puts limits on homeowner rights–even when one is the victim of a fraudulent builder.

Session 3 was led by Gil Mars (SCA Resident and long-time home plumbing maintenance volunteer). Gil gave an exceptionally valuable presentation with many photos of problems and on how to double water heater effective lives from an average of 4 years to more than 8 years.  Even those in the audience well versed in such matters were overheard to remark about how valuable Gil’s recommendations were. This topic will need to receive much wider exposure in the future. Considering the big turnout for the evening with such highly focused questions for over 2 hours, it was obvious that SCA residents are starved for specific information on how to cope with constantly changing construction defects issues, and how to deal with Nevada’s water corrosion problems. New and complex issues are frequently popping up. The full information is almost never available, solutions are rarely obvious, and results are usually expensive.

Many residents asked for regular meetings on these issues. It was clear the Board of Directors should be sponsoring these events. At least the board should not be charging $100 per room for the opportunity to put them on. Please send email to anthemvoice@cox.net with your opinions.

Calling All SCA Veterans!

For all SCA Veterans:

On November 13th at 11 AM, Thunderbird Pilot Major Kirby Ensser, USAF, will be the luncheon speaker for the SCA Women’s Club.  In honor of our veterans and Veteran’s Day, November 11th, we would like to extend an invitation to SCA Veterans to attend this unique luncheon, and we are requesting assistance from the SCA Veterans SIG and the blog operators to help spread the word on this event.

SCA is extremely grateful to be able to have Major Ensser, USAF, as our speaker this month.  Thunderbird Pilots rarely have time to make pubic presentations.  The Thunderbird Team travels worldwide most weeks during the year, and even when they are home with family and friends, they usually have to fly twice a day to develop new skills and maintain their high levels of aerobatic proficiency. This luncheon promises to be a truly memorable occasion for our community.

Our luncheon will start at 11 AM on November 13 in Hanneman Hall. A catered buffet meal by Chef Neal will be followed by Major Ensser’s presentation.  For this event, we have waived the guest fee for veterans, and the luncheon charge will only be $25.00–the standard price to women’s club members.

Veterans wishing to attend must make a reservation with payment made in the Women’s Club mailbox by Sunday, November 9th by 5 pm.  The payment should be inserted into the locked box in the SCA mail room to the left of the SCA club mail boxes.

We plan to set aside reserved tables for our veterans, but individual veterans may request to be seated with others at different tables.  If you wish to be seated with any specific person or persons, please include the information on a note attached to your reservation when it is placed into the Women’s Club mailbox.  

We look forward to having our veterans attend our Women’s Club November luncheon, and we welcome the opportunity to recognize you at this very special event.
